General Terms and Conditions (GTC)

    These General Terms and Conditions (GTC) govern the contractual relationship between EAMT GmbH, Sihleggstrasse 23, 8832 Wollerau, UID CHE-210.634.957 (hereinafter "EAMT"), and the users of the website and service platform (hereinafter "users" and "platform"). These GTC apply to all use of the platform and to all services offered by EAMT, subject to an express separate agreement.

    EAMT is an authorised digital intermediary for debt enforcement register extracts in Switzerland. As a registered eSchKG participant (ID 1417) with the Federal Office of Justice and an active SEDEX participant (Sedex ID 4-800248-6) with the Federal Statistical Office, EAMT is directly connected to the systems of Swiss debt collection offices.

    EAMT does not issue debt enforcement register extracts itself but enables users to order them via the platform in digital, electronically signed form. The extracts are issued by the relevant debt collection office and bear a qualified electronic signature (QES). EAMT acts on behalf of and in the interest of users.

    1. Scope

    2. Contractual Relationship

    2.1 Formation

    The contractual relationship between EAMT and the user is established:

    • by registering for a user account; or
    • by placing an order, if no registration for a user account is made.

    2.2 Termination

    The contractual relationship expires automatically upon deletion of the user account or, in the absence of a user account, upon delivery of the ordered documents. The contractual relationship may also be terminated at any time with immediate effect by email to info@eamt.ch (acknowledgement of receipt required).

    3. Services of EAMT

    3.1 Services in general

    The platform is available to natural and legal persons domiciled or headquartered in Switzerland.

    As an authorised eSchKG participant, EAMT provides debt enforcement register extracts from all debt collection offices in Switzerland. The digitally signed extract is legally valid and accepted by authorities, banks, insurance companies and landlords. Authenticity can be verified at any time on validator.ch, the validation service of the Swiss Confederation.

    EAMT endeavours to provide the platform on a durable and reliable basis but cannot guarantee any specific availability. EAMT is entitled to modify, restrict, expand or interrupt the functionalities, design, content or scope of the platform at any time. Data backup is the responsibility of users.

    3.2 Orders and delivery

    EAMT endeavours to process orders as quickly as possible. EAMT delivers the debt enforcement register extract by email as fast as possible. Exact delivery times depend on the processing time of the relevant debt collection office and may vary. EAMT accepts no liability for delivery times.

    Orders are binding. There is no statutory right of withdrawal. Electronically signed PDF documents, such as debt enforcement register extracts, may be forwarded by users an unlimited number of times.

    For multiple orders, it is the user's responsibility to ensure that the correct debt collection office is responsible for the residential address provided.

    3.3 Prices

    The price for a debt enforcement register extract is CHF 29.90 incl. VAT, composed as follows:

    • Office fee of the debt collection office: CHF 18.00
    • EAMT service fee: CHF 11.90

    EAMT reserves the right to adjust prices at any time. The price applicable is that indicated on the platform at the time of the order.

    3.4 Collaboration with CRIF AG

    EAMT works with CRIF AG (Switzerland). For orders on account, data is transmitted to CRIF AG to verify the creditworthiness and identity of the user. CRIF AG processes this data as an independent controller in accordance with its own privacy policy (www.crif.ch/datenschutz). Further information can be found in our privacy policy.

    3.5 Rejections and refunds

    Debt collection offices may reject orders, in particular for the following reasons:

    • Incorrect personal data (first name and surname not identical with data on the identity document)
    • Address without corresponding corresponding registration
    • Weekly residence address instead of main domicile address
    • Significant discrepancy between the signature provided and that on the identity document
    • Invalid or expired identity document

    In the event of a rejection, the rejection fees charged by the office plus a flat processing fee of CHF 6.00 are charged to the user. The original order is deemed fulfilled in the event of a rejection.

    In the event of a refund, a flat processing fee of CHF 6.00 is charged.

    3.6 Newsletter and communication

    EAMT may send users a newsletter by email containing information and offers, provided that the user has expressly consented. The newsletter can be unsubscribed at any time via the unsubscribe link in each email.

    4. Payment Methods

    EAMT offers various payment methods, including credit card, TWINT, PostFinance and PayPal. EAMT reserves the right to restrict or modify payment methods at any time.

    5. Intellectual Property and Right of Use

    5.1 Intellectual property

    All rights in connection with the platform, in particular rights to company names, know-how, trademarks and software, as well as all information available directly or indirectly in connection with the platform, belong exclusively to EAMT and/or authorised third parties.

    5.2 Right of use and power of attorney

    With each order, users grant EAMT the mandate and power of attorney to execute a legal transaction on their behalf on a one-time basis, in particular to request a debt enforcement register extract from the relevant debt collection office. The individual order is decisive.

    EAMT is entitled to exclude users from using the platform or to block or delete user accounts, in particular if there is a substantiated suspicion that a user has used or will use the platform in an abusive, immoral, unauthorised or unlawful manner.

    6. Obligations of Users

    Users are obliged to:

    • treat the access data for their user account confidentially and protect it from unauthorised access;
    • provide only correct and complete information;
    • immediately report to EAMT any violations of these GTC and any unauthorised use of their user account;
    • ensure at their own expense the technical requirements for using the platform.

    7. Warranty, Liability and Indemnification

    7.1 Warranty

    EAMT provides no guarantees, warranties or assurances in connection with the platform and its use, in particular not regarding the timeliness, accuracy or completeness of information, the quality of service or availability.

    7.2 Liability

    EAMT accepts no liability for the timeliness, accuracy or completeness of debt enforcement register extracts issued by debt collection offices.

    EAMT excludes all liability for direct and indirect damages in connection with the platform, to the extent permitted by law. This exclusion does not apply to damages caused by wilful misconduct or gross negligence on the part of EAMT.

    Liability for auxiliary persons is excluded to the extent permitted by law (Art. 101 CO).

    EAMT accepts no liability for delivery times of debt enforcement register extracts. If a user receives an invoice directly from a debt collection office, we ask the user to forward it immediately to info@eamt.ch.

    7.3 Indemnification

    Users undertake to fully indemnify EAMT if EAMT is held liable by third parties for damages directly or indirectly related to the user's use of the platform.

    8. Final Provisions

    8.1 Amendments

    EAMT is entitled to amend these GTC at any time. The current version is available on the platform. By placing an order, the GTC in force at the time of the order are deemed accepted.

    8.2 Severability clause

    Should any provision of these GTC be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.

    8.3 Applicable law and jurisdiction

    The contractual relationship between EAMT and users is exclusively subject to Swiss law. The exclusive place of jurisdiction is the registered office of EAMT in Wollerau, Canton of Schwyz, Switzerland, to the extent permitted by law. Actions by EAMT at another permissible place of jurisdiction are reserved.
